Another arrest warrant out for Raja Petra (Update)

KUALA LUMPUR: Malaysia Today editor Raja Petra Raja Kamarudin was slapped with another warrant of arrest after he failed to turn up for his criminal defamation trial at a Sessions Court here.
Sessions Court judge Mohamad Sekeri Mamat issued the arrest warrant after DPP Anselm Charles Fernandis applied for the order.
The judge also issued a show-cause notice to the former Internal Security Act detainee’s wife, Marina Lee Abdullah, as his bailor, for not being at court to explain his absence.
An arrest warrant was also issued by the Petaling Jaya Sessions Court on April 23 against Raja Petra after he failed to turn up for his sedition trial. He had claimed trial on May 6 last year to publishing a seditious article on April 25 via his news portal.
When asked about the presence of prosecution witnesses in court Tuesday, DPP Anselm told reporters that 12 policemen and two civilians had been subpoenaed for the trial.
Raja Petra, 59, had on July 17 last year claimed trial to three counts of criminal defamation over his statutory declaration on the murder of Mongolian translator Altantuya Shaariibuu.
The father of three boys and two girls is alleged to have defamed the then Deputy Prime Minister’s wife, Datin Seri Rosmah Mansor, by making a libellous statement in the declaration which he affirmed on June 18 when he knew that it would tarnish her good name.
The grandfather of four also faces two similar charges against Leftenan Kolonel Norhayati Hassan and her husband Leftenan Kolonel Abdul Aziz Buyong.
Raja Petra is said to have committed the offences at High Court (Civil 5) at the Jalan Duta court complex at 10:25am on June 18, last year.
At the outset of court proceedings, DPP Anselm applied for the arrest warrant against the editor and the notice for his wife saying that both were aware that the criminal defamation trial was set for three days from Tuesday.
Raja Petra’s lawyer, Amarjit Singh Sidhu, told the judge that the defence team was waiting to get a trial date at the Court of Appeal for their appeal on the transfer order involving the same case.
“We have now received the appeal records. It is on the transfer of this case from the Magistrates Court to the Sessions Court,” he added.
Upon hearing this, DPP Anselm told the judge that it was a separate matter.
The judge agreed that it was a different issue and immediately issued the order.
He set July 2 for mention of the arrest warrant and show-cause notice.
Raja Petra had failed in his bid on Feb 13 to get his case transferred back to the magistrate’s court for trial.
He had on Nov 25 applied to the High Court to have his case heard by the Magistrates Court.
However, High Court Judicial Commissioner Zainal Azman Ab Aziz ruled that the decision by magistrate Nazran Mohd Sham on Aug 15 last year to transfer the case to the Sessions Court upon application by the Public Prosecutor under Section 177 of the Criminal Procedure Code was valid and in order.
Raja Petra claims to be in a self-exile from Selangor because of a dispute with the state’s Palace.
He claimed in a Malaysia Today article that he would not be attending the hearings not only because of his brush with the Palace but also due to his fear of another Internal Security Act arrest.
He also said that he did not want to face possible treason charges.
According to the press report, the police believes that the editor is now in Brisbane.
This is bad. Son of RPK, Raja Azman Raja Petra is being detained by the police for theft cases. RPK has a lot to answer for. RPK himself is immune to police custody and saman menyaman but this is yet another big big obstacle. And it has become personal. BN leaders are probably grinning from ear to ear as they can make this issue really personal and insulting. RPK is now push to the limit to pull out excuses to deflect incoming insults from all direction.
Raja Azman Raja Petra, a son of Malaysia Today editor Raja Petra Raja Kamarudin, pleaded guilty to four separate counts of theft, receiving stolen property and criminal trespass.
Raja Azman, 32, who was dressed casually in a pair of blue jeans and a T-shirt with the word “Russia” on it, appeared before magistrate Norkamilah Aziz here Tuesday at about 11:30am.
In the charge read out to him, he was accused of stealing a Nokia mobile phone, a Seiko watch, and a bunch of motorcycle keys, all worth about RM3,850, belonging to student Saipul Adli Mohamad Yunus, 21, at No 16, Jalan Sastera, U2/1K, Section U2, Shah Alam, at about 10am on April 24.
He was also accused of stealing a Yamaha 135 LC motorcycle worth about RM6,000 from student Ahmad Firdaus Jalaludin, 23, at the same location and time.
He admitted to the alternate charge of being in the possession of a Yamaha 135 LC motorcycle worth about RM6,000 with the knowledge, or with cause to believe, that the motorcycle was stolen property.
Raja Azman also pleaded guilty to another count of motorcycle theft, this one of a Yamaha RX2 worth about RM8,000, at 9:30am on March 20, at No 65, Jalan Batas 2, 19/6B, Section 19, Shah Alam, belonging to operator Mohd Syaiful Setapa, 24.
Lastly, he was also charged with breaking in into a house at No 65, Jalan Batas 2, and stealing Mohd Syaiful’s wallet containing his identification card, RM20, road tax, Maybank and BSN ATM cards and his driver’s licence.
If convicted, he faces a jail term of up to 10 years, with a fine.
Magistrate Norkamilah set bail at RM10,500 in total, with one surety for each charge. She fixed June 19 for sentencing.
The Shah Alam High Court this morning ruled that the detention of well-known blogger Raja Petra Kamarudin under the ISA was illegal and ordered his immediate release by today.
On September 22, 2008, the police sent Raja Petra Kamarudin to Kamunting to serve his ISA detention with trial.

Court frees Raja Petra
SHAH ALAM: Malaysia Today editor Raja Petra Kamaruddin is to be freed Friday.
He succeeded Friday in his bid to obtain a release order from detention under the Internal Security Act (ISA) via his habeas corpus application.
The judge ruled that the Home Minister had acted outside his jurisdiction when he issued the two-year detention order under Section 8(1) of the ISA.
The High Court here also allowed Raja Petra to be brought to court to be released today.
He was detained for a second time under the ISA on Sept 12.
On April 11, 2001, Raja Petra along with 10 other activists were detained under the ISA for allegedly plotting to overthrow former prime minister Tun Dr Mahathir Mohamad. Raja Petra was released 52 days later.

2008 will be one of those painful years for Raja Petra Kamurudin and fellow Malaysian bloggers, especially those in the political theme blogs.
RPK, Teressa Kok, Tan Hoon Cheng and Sheih Azidi (Kickdefella) were arrested and detained under Malaysia draconian Internal Security Act for various reasons known only to the government brass.
Of the four, Tan Hoon Cheng was released first. Read Tan Hoon Cheng ISA detention ordeal. Teressa Kok was released after one week behind bars followed by Sheih Azidi (Kickdefella). Kickdefella was held for 3 nights in the Dang Wangi Police lock-up before he was released.
Raja Petra Kamarudin, the pain in the government arse is however, thrown to Kamunting detention centre for 2 years under Section 8 of ISA. Enough for RPK to gain a Masters while in the cell. But the outlook is gloomy as RPK's detention can be renewed indefinitely. Someone is making sure that RPK is hidden from the public until after 2010.
So, instead of giving a sincere Hari Raya gift to all Malaysian, the government did better by give RPK an early Hari Raya gift.

The police have arrested an opposition politician (Seputeh MP Teresa Kok), a prominent blogger (Raja Petra Kamarudin of Malaysia-Today.net) and a journalist (Tan Hoon Cheng of Sin Chew Daily) in a sudden crackdown as the opposition plots to seize power.
Abdullah Ahmad Badawi must be scared shit to impose the detention (without trial) of the three under the draconian Internal Security Act. The ISA crackdown is a travesty of justice honed to perfection by a regime afflicted with dementia. Didn't someone once say, ‘those whom the gods wish to destroy, they first make mad?’
Ahmad Ismail, the person who started the fire was only slapped lightly on the wrist.

Raja Petra, Teresa Kok and Sin Chew reporter arrested under ISA
PETALING JAYA: Malaysia Today news portal editor Raja Petra Kamarudin, Seputeh MP Teresa Kok and Sin Chew Daily reporter Tan Hoon Cheng were arrested under the Internal Security Act (ISA) here and in Penang.The first person to be picked up was Raja Petra, 58, from his house in Sungai Buloh near here, followed by Tan, 32, who was arrested from her house in Bukit Mertajam, Penang. Teresa, 43, was detained at 11.20pm as she was on her way home in a car.
All of them were arrested under Section 73(1) of the ISA for allegedly being a threat to security, peace and public order.
A team of police officers from Bukit Aman arrived at Raja Petra’s house at 1.10pm and led him away 40 minutes later.
The team also took some 15 VCDs on ceramah held by Opposition Leader Datuk Seri Anwar Ibrahim as well as 16 books.
Last week, the Department of Islamic Development (Jakim) and several Muslim bodies lodged a police report against Raja Petra, who is already facing criminal defamation charges for allegedly insulting the Malays, Muslims and Islam.
In a statement, Deputy Inspector General of Police Tan Sri Ismail Omar said Raja Petra was arrested based on surveillance that showed that he was involved in activities that could cause unrest among the multi-racial and multi-religious society of the country.
Tan, who was picked up at 8.40pm, was taken from her house in Taman Seri Rambai in Bukit Mertajam to the state police headquarters on the island.
Tan, 32, reported former Bukit Bendera Umno division chief Datuk Ahmad Ismail’s racist remarks while campaigning for the Permatang Pauh by-election.
Lee Kelvin from Guang Ming and Tan Ming Xao from Nanyang Siang Pau, who had vouched for the accuracy of Tan’s report had gone into hiding.
Kok, 43, who is also state assemblyman for Kinrara and the senior Selangor state executive councillor, was picked up over an alleged involvement with a resident’s petition over a mosque.
Acting Inspector-General of Police Tan Sri Ismail Omar confirmed the arrests of Tan and Kok.
Under the Section, police are empowered to detain the trio for a period of 60 days after which the Home Minister can decide on further detention.
Home Minister Datuk Seri Syed Hamid Albar admitted that the decision to detain people and issue show cause letters would be unpopular and would be criticised but it had to be done.
“While we may want to be popular, freedom without responsibilities has ramifications.
“We have to take action to protect the wishes of the majority,” he said.
Syed Hamid also said Raja Petra had been warned on many occasions in the last two years.
“Now, with so much public uneasiness, we do not want anything that can threaten peace in the country.
“The police looked at all aspects and, under present circumstances, the actions were necessary,” he added.

Sin Chew Daily reporter Tan Hoon Cheng is believed to have been arrested over her report on former Bukit Bendera Umno division chief Datuk Ahmad Ismail’s racist remarks while campaigning for the Permatang Pauh by-election last month.
Tan, 32, is an award-winning journalist with nine years of experience. She is a Mass Communication graduate from Universiti Sains Malaysia.
DAP’s Seputeh MP Teresa Kok is also assemblyman for Kinrara and a senior executive councillor in charge of investment, industry and trade.
Kok, 43, is believed to have been picked up in connection with a residents petition in Puchong over a mosque.
Former mentri besar Datuk Seri Dr Mohd Khir Toyo had allegedly accused Kok of being involved.
She subsequently denied the allegation and demanded an apology from Dr Mohd Khir and the newspaper which reported it.

Yesterday, the Malaysian Police arrested Anwar Ibrahim, the leader of Pakatan Rakyat for sodomy related case and for scaring that Anwar may not turn up at the Police station.
Today, the Malaysian Police arrested Raja Petra Kamarudin, the owner of Malaysia-Today for his over-sentive Statutory Declaration.
Next on the arrest list could be Mahathir Mohamad (the ex-PM of Malaysia is now a rogue and a pain to Barisan Nasional's back side).

Raja Petra arrested
PETALING JAYA: Malaysia Today editor Raja Petra Kamarudin was arrested Thursday morning under Section 500 of the Penal Code for criminal defamation, and is now on the way to the Jalan Duta Courts to be charged.
The charge was being made over his June 18 statutory declaration on the murder of Mongolian translator Altantuya Shaariibuu.
